Harvey World Travel (Hornsby) is operated by Fine Travel Pty Ltd ABN 11 109 344 584, travel agents license number sTA02558.

“You” means any user of this site and includes any person who receives a Service (whether or not that Service was acquired by another person);
“Service” means making this site and any software associated with it available to you and providing a facility to enter into transactions with third parties, whose details and products and services appear on this site.

Using this Website

Using this website means you accept these terms and conditions. We may at any time modify these terms and conditions and the changes will come into effect once they are uploaded into this website.  You acknowledge and agree that your continued use of this website is subject to the terms and conditions in force at the time of your use.

Agency

You acknowledge that: (a) we act as an agent for third party suppliers of all products and services contained on this site; (b) all information on this site relating to products and services of third parties do not form part of the Service; and (c) we are not responsible for, and make no warranty or representation about, third party suppliers, their products and services or information provided on this site about their products and services.  Many suppliers impose their own special conditions for the various products and services they offer.  For example, suppliers may have rules and restrictions about the use and availability of fares, products and services, refund and cancellation policies and the limitation or exclusion of liability for death, personal injury, delay and loss or damage to baggage.  It is your responsibility to check the specific terms and conditions of each supplier before you acquire any product or service from them through this site. 

Your Obligations and Warranties

In consideration of Harvey World Travel (Hornsby) permitting you to use the Service, you warrant to us that: (a) you are at least 18 years old and have the power and authority to enter into a binding contract with us and with the suppliers of products and services that you acquire; (b) the information you provide us about yourself is true, accurate, current and complete (apart from any optional items) as required by any registration process; and (c) you will maintain and promptly update this information to keep it true, accurate and complete.  
You must use the Service in accordance with these terms and conditions and must not use the Service in any way to breach any laws or defame anyone.  You agree to indemnify us from and against all claims, actions, suits, demands, liabilities, costs or expenses, losses including consequential losses, whether arising directly or indirectly from the use of the Service by you or any person using the Service through any means provided to you.

Fees and Charges

We may charge a fee for making a booking on your behalf.  You acknowledge that we may receive a commission from suppliers for bookings made on your behalf.  We reserve the right to charge administrative fees for payments made by credit card.  These changes range from 0-4% dependent on what credit card issuer is utilised.  Please ask us for details.

Currency

All pricing on this site is reflected in Australian Dollars unless otherwise specifically denoted on the screen

Our Liability to You is limited

Certain statutory warranties under consumer protection laws will be implied for the benefit of consumers. Nothing in these terms and conditions is intended to exclude or restrict the application of such laws but we do not give any guarantees or warranties or make any representation of any kind, express or implied, with respect to use of this website or the Service outside these laws.

Subject to claims available under consumer protection laws, we are not liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including specific, indirect, consequential or economic loss) however caused and which is suffered directly or indirectly in connection with the:

•    use of (or inability to use) this Website, the Service or any linked site;
•    disruption to this Website or the Service;
•    the delivery or non-delivery of products or services acquired by using the Service; and
•    any act or omission of suppliers or third parties.

To the maximum extent permitted by law, Harvey World Travel (Hornsby) excludes all liability for direct, indirect, consequential or incidental damages, lost profits or savings or damages for disappointment.  Our liability for a breach of a condition or warranty implied by law or otherwise, and which cannot be excluded, is limited to the extent possible, at our option to the supply of the services again or the payment of the cost of having the service supplied again.

Jurisdiction and Law

Use of this site, all maters arising out of or in connection with it and all terms are governed by the laws applicable in NSW.  By accessing this site, you consent and submit to the non –exclusive jurisdiction of the Courts of NSW in all matters arising out of or in connection with your use of this site and terms.

We collect your personal information directly from you in the course of providing a product or service or when you have other dealings with us.  For example, your personal information will be collected when you deal with us over the telephone, send us a letter or an email, visit our website, complete an online registration form, provide information to complete a booking, subscribe to a service provided by us or when you visit a Harvey World Travel owned office or agency.

We only collect personal information about you that is relevant to your travel arrangements or that will enable us to provide you with our goods and services.

-    consider your request for a product or service;
-    provide you with information about other products and services that that may be of interest to you;
-    assist in arrangements with suppliers (such as airlines, tour operators, car hire operators, hotels and insurance providers) in relation to the provision of a product or service; and
-    Perform all other administrative and operational tasks (including risk management, systems development and testing, staff training, and market or customer satisfaction research).

When do we Disclose your Personal Information?

We will not disclose your personal information for any purpose other than the purposes contained in this Privacy Policy.  We may disclose your personal information where we are required by law to do so.
We will disclose your personal information to suppliers (such as airlines, tour operators, car hire operators, hotels and insurance providers) of products or services which you have purchased.  You acknowledge that not all suppliers may have privacy policies equivalent to our Privacy Policy and you consent to the disclosure of your personal information for this purpose.
Promotions by us may be sponsored by a third party or may be co-sponsored.  Some or all of the information collected during a promotion may be disclosed to the party which sponsors or co-sponsors the promotion.  We may disclose your personal information to third parties when we contract out some of our functions and activities.  For example, we may provide names and addresses to a mailing house to send brochures or marketing material to you.  In these circumstances, we prohibit third parties from using your personal information, except for the specific purpose for which we supply it.

We store personal information in a combination of secure computer storage facilities, paper based facilities and other records.  
We will endeavour to take all reasonable precautions to maintain the security of the information in our systems.  We use a combination of security measures to prevent the unauthorised access of our servers and regularly review our security policies.

We will disclose your personal information to travel suppliers and other suppliers of goods or products that you purchase, which may be overseas.  We may also disclose your personal information as permitted in this Privacy Policy to related entities or subsidiaries which may be overseas.  You accept that overseas suppliers may not have in place equivalent privacy policies.  Our website may contain a number of links to other websites.  We are not responsible for privacy policies of any linked website.  You should check the privacy policy of any linked website.

Accessing and Updating your Personal Information

Subject to some exceptions contained in the Privacy Act, you can find out what personal information we hold about you.  You can contact us to find out about the personal information we hold about you.  We will need to verify your identity before giving you access.  Depending on the complexity of your request, we may charge a fee for processing the request.
Your personal information may be accessible to you on our website with your password or to any other person who has your password.  We do not collect personal information about you from any other source and will rely on the accuracy of information you provide us.
If your personal information changes, please update it using your password or contact us.

We will only collect, use or disclose sensitive information with your consent and where it is desirable for your travel arrangements.  Otherwise, we will not collect, use or disclose information unless required to so by law.  Sensitive information, as defined by law, is any information about a person’s racial or ethnic origin, political opinion, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record or health information.

Information about Other Travellers

If you provide us with information about other people travelling with you (for example, family members), you warrant to us that you are authorised to provide their information and that you will make them aware of this Privacy Policy and their rights under it.

Marketing and Privacy

Serving customers well is very important to us.  As part of this service, we may use your personal information to identify a product or service that you may be interested in.  We may contact you from time to time to let you know about new or exciting products or services and special offers.  You may contact us at any time if you do not wish to receive marketing information.
